1) Give less evidence on the original pullover
“Give them fewer clues or probable cause for arrest. In every arrest report, officers typically say there’s an odor emitting from the driver’s breath, and the driver has glossy or blood-shot eyes. They use these observations as part of their probable cause for your arrest. If you’re not talking, they’re less likely to smell alcohol on your breath. Don’t even talk to them, give them your insurance, and don’t answer any of the probing questions. They do it to get you off-guard, so they have evidence to use against you in court.”
2) Refuse sobriety test
“If an officer thinks you may be impaired, they’ll ask you to do a sobriety test. In most states, they’re voluntary, and there are a few different ones they do. But I always advise not to submit to them because their observations can be used as probable cause for your arrest, and it can be used against you in court. There may be some collateral consequences if you refuse, but those usually don’t involve loosing your freedom.. In Maryland, you could go to jail for one year, get 12 points on your license and get hit with a heavy fine if convicted of DUI.”
3) Hire a defense attorney
“You’re going to want to hire a defense attorney because if you get a DUI in Maryland, you’re usually hit with reckless and negligent driving, and the MVA can suspend your license. Those are two different consequences you have to face. One’s from your DUI case in criminal traffic court, and the other is from your MVA hearing.”
