The claim made by Federal government stating that it can ban foreigners the right to vote and donate in the local and state elections has prompted a sharp series of questioning from the court panel for federal appeals this week.
Three of the 9th Circuit Judges actually had challenges brought along by 2 men on Wednesday who were convicted of violations made against campaign-finance in San Diego. Lawyers for the political consultant named Ravneet Singh along with the Mexican Businessman Jose Azano said in the legal briefs that federal law implementing a ban on the campaign donations made by the foreigners is actually unconstitutional, especially when applied for the non-federal elections.
This is true to the core for foreigners that come with significant ties with the U.S. However, U.S. Attorney name Helen Kong responded over this constitutional question by stating that the Congress has a well-established position to ban the foreigners from functioning in the U.S., possessing firearms, or establishing a permanent residence without proper permission. Given the fact that elections are also within the borders of the U.S., the congress can indefinitely establish a ban on foreigners willing to vote or donate.
